    Background:
    Pending an action under FELA for injuries sustained by plaintiff, Peter Potrykus ("Potrykus") to his knee, defendant, CSX Transportation Inc. ("CSX") filed a motion in limine to exclude testimony, evidence, and argument as to FELA being Potrykus' only remedy, and photographs and documents showing the location of the injury, but which predate Potrykus' employment.

    In response to the application of FELA, Potrykus argues that he wants to make a brief statement to the jury clarifying what remedy he is entitled to receive. Potrykus also maintains that the photos and documents are relevant to describing the conditions present at the time of the accident.
