All rules are not the same. Why do you think some rule violations get a guy an ass chewing, whereas, some rule violations get a guy dismissed. Never have heard a railroader say that breaking rules that do not get folks hurt is okay. You must be one of those folks who will never understand.

Oh i get it. But you don't. If you going to throw the book at someone who violates rule A, then throw the book at someone who viloates rule B. That is what I mean by treat them the same. The same way it wouldnt be fair to punish someone harshly for breakin a rule because you don't like them, and being lenient on the guy you like who violate the same rule. But hey i have an open mind, something many railroaders lack. Anyway this has been drawn out enough. you guys have fun. oh and for the last time i am not saying do not punish the guy fokes keep overlooking that point. I am saying do not ruin his life, let him get a second chance that he deserves.

It's simple. You violate a rule, you pay the consequences. You cause injury while violating the rule, you pay legally. She knew she was breaking a rule and she caused injury.

On a side note, if she is convicted, do they have a prison for transsexuals?

My comment was more directed at the issue that the use of electronic devices such as cellphones, PDAs and whatever else have been on the list of hot topics ever since the California METROLINK crash last year.

Seems to me that EVERYONE should be mindful of that fact, and would be taking great care to NOT get caught doing it. In my opinion, if you're dumb enough to do it, despite it's status as a hot-button topic in the media and the powers that be at the NTSB, FRA, DOT, and whereever else, then you deserve to "have the book thrown at you". Because it's obvious that nothing else will have enough of an impact to make you rectify that behavior.

What could have been SO important that she had to be texting someone anyways, that couldn't have waited until she stopped to make a phonecall, or until she got off duty?

No, instead she needed to text her friend about ladies night or some bullshit, and a bunch of people were taken to the hospital as a result. She's only fortunate that nobody was killed, I sure as hell wouldn't want that on my conscience. But then, some people have no morals anyways. . .
