Yes he made a mistake. So none of you have violated any federal, or company rule? How many people broke rules only to be given a second chance by the union? Let he with out sin cast the first stone. Remember that. Punish yes, but I'm sure he feels remorse for what happened, and if had a second chance would not do it again. Doesn't everyone deserve a second chance like i'm sure some of you have had in ur lives?

She or he, whatever this person is now, deserves her day in court. Everyone knew that the FRA and the companies will come down hard on the new cell phone rules and the Emergency Order. But she did it and passed 2 signals. That is a bad thing.

The thing I think could help her is that she was honest about it. I hope the best for her.

Yea i have broken a rule or two. Smoked in the cab, train moved an inch when i stepped off, stretch braked, stuff like that.

But this guy made a life threataning "mistake". would you cut me a break if i say pulled past a red signal to get a better look around the corner? or just start charging the air while someone is in still in between? Or lets just shove back to clear a switch with no regard for anyones safety! Would you cut me a break for that shit I know is wrong but its just a "mistake"

You cannot choose which rule you will follow or brake. In the eyes of the company 100% rule compliance!! You should be fired and given no second chance. I didn't say cut him a break good job trying to twist my opinion how mature. Read what I said!! I said he should be punished he broke the rule, the same way you should be. A rule is a rule. I also feel that he should be given a second chance they same way you and many others. Are you saying for your entire railroad career you have never used your phone while on moving equipment? Everyone saying throw the book at him can you all say you have never used your phone while on moving equipment? Like prostock19 mention the guy admitted he messed up from the start, shows remorse to me. Oh and please do not twist my words to make your point seem more rational, that is very ignorant.

Would it make you feel any beter if a drunk driver felt remorse after killing one of your family members?
Or would you prefer justice to be served to an adult that made a desicion that he knew was proven to be very dangerous?

If this person is allowed to slide or they take it easy on them, they are only opening the door for for lives to be at risk.

No one was killed. If someone was then it is a different crime. You can not compare the two. So you are saying you have broke no rule and gotten away with it? When you were allowed to break rules and not be punished it allowed you to no be a worst employee? You are saying this person will not learn from the mistake they made? It is so funny how people can easily become hypocrites when looking from the outside.

By the way the question was have anyone one used their phone while on moving equipment? Have you or have you not? Voice or not cell phone use is cell phone use. Txting or voice they are both distractions!
