Default FMLA and AWTS

Anyone know whether FMLA absences count against the 2 days unavailable in 120 (180 in some places) rolling days. Gut feeling is that FMLA is a sacred cow and probably can't be touched but we also know that UP believes it is above the law.
Anyone have any idea who to call to find out...Local Chairman is trying to get to Gen Chair but isn't having much luck.

I was wondering the same thing, though I am pretty sure you'll lose your guarantee, hell I've been tring to get two of my vacation days, they keep telling me I can't use them even though there's five other guys on the board who have, CMS make this shit up as they go along.

Our agreement, Portland Zone 1 and 2, specifically outlines the vacation and personal leave days...you can't use 'em on your days of protection. FMLA has always been a thorn in their side and as it was not specifically addressed in the agreement it's a grey area. We know that the Feds don't play around with FMLA so I'm thinking they may be able to take money from you but not your job, i.e. placing you in furlough status if you've made yourself unavailable 2 days out of 180. FMLA should be a no brainer but I don't want to be the guy who tests the waters...just wondering if anyone knew for sure...for sure and UP doesn't exist though.

Our agreement outlines the same thing, well at least with personal days, I've been told it's the same with vacation days, I guesss I'm not reading it right though, because it's escaping me, but as usual, CMS do what the hell they feel like when they feel like it, because yesterday, someone used a personal day and at the moment there are 5 people scheduled a single day vacation on days they cover, after all, what would be the use of using one on a day you didn't cover?
