It doesn't have to be while on duty, but it does require it to be due to an accident that was at work...
"...as long as the death was not due to a natural occurence and was the result of a work accident." that's in the FBF bylaws attachment VI-2

BENEFICIARY DISTRIBUTION GUIDELINES FOR THE FALLEN BROTHER FUND PREAMBLE The Fallen Brother Fund [FBF] was established to provide donations to the beneficiaries of railroad workers who die in the line of duty. It does not matter whether the death was the result of an accident or illness. The only requirements are (1) that the railroad worker was “on duty” at the time of death and (2) that he/she was a member of a recognized U.S. railroad employee labor union in the employ of a Class I, II or III railroad, AMTRAK or a commuter line. The FBF was officially formed on June 4, 2009. The fund is a non-profit charity, registered with the Internal Revenue Service under 501 (c)(3) of the Internal Revenue Code. As such, all donations made to the FBF are tax deductible. Until the FBF has raised, and has on deposit with its bank account located at Metro Bank in Southside, Alabama [the "Distribution Account"], the amount of $10,000.00, it will only give $300.00 to the qualified “Beneficiary” of a deceased worker. However, once the fund raises at or above $10,000.00 in its Distribution Account, the distribution guidelines and amounts will be distributed as follows: Fund Balance: between $10,000 and $19,999 – benefit will be $400 between $20,000 and $29,999 – benefit will be $500 between $30,000 and $39,999 – benefit will be $600 between $40,000 and $49,999 – benefit will be $700 between $50,000 and $59,999 – benefit will be $800 between $60,000 and $69,999 – benefit will be $900 $70,000 and above – benefit will be $1000 BENEFICIARY ENTITLEMENT REQUIREMENTS The requirements of the FBF to establish an entitlement to monies are that the FBF be provided (a) a certified copy of a death certificate; (b) a copy of the most recent paycheck stub, issued prior to the date of death; (c) the physical address of the decedent at the time of death; (d) if the decedent had a Will, a complete copy of the Will; (e) if a lawyer has been employed to handle the legal affairs of the Estate of the decedent, the name, address and phone number of the lawyer; (f) the names, addresses, dates of birth and Social Security numbers for (1) the spouse of the decedent, if the spouse is to be the beneficiary; (2) the children of the decedent, if the children are to be the beneficiaries; or (3) the parents of the decedent, if the parents are to be the beneficiary; and (g) proof of membership in a recognized railroad employee labor union. This information is to be mailed to: FALLEN BROTHER FUND Beneficiary Information Division 1099 Lakemont Drive South Southside, Alabama 35907 Once the entitlement to Beneficiary Distribution requirements have been satisfied, a check will be distributed within five (5) business days to the appropriate address. Well thanks anyway. I figured someone would respond but I got no PMs. I'll do all my donating locally since the FBF isn't for families who lose their Railroader if he didn't expire at work.
